1. General Provisions

1.1. The Online Store available at folia.flowers is operated by the company “Marianna Bersenieva”.

1.2. The Seller is the Administrator of personal data processed in the Online Store. Data processing is carried out in accordance with the Privacy Policy published on the website.

1.3. Definitions:

  • CUSTOMER โ€” a natural person (with full legal capacity), a legal person, or an organizational unit concluding a Sales Agreement with the Seller. Note: For the purchase of alcoholic products, the Customer must be at least 18 years old.
  • SELLER โ€” the company folia.flowers.
  • PRODUCT (GOODS) โ€” movable property available in the Store (flowers, gifts, etc.) which is the subject of the Sales Agreement.
  • STORE โ€” the online service available at folia.flowers.
  • ORDER โ€” the Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying the type and quantity of the Product.
  • ORDER FORM โ€” an interactive form on the website allowing the placement of an Order, selection of Products, and delivery methods.

2. Types of Electronic Services

2.1. The following free electronic services are available in the Store:

  • Account Maintenance (User Account);
  • Interactive Order Form;
  • Newsletter Subscription;
  • Contact Form.

2.2. Terms of Use:

  • Order Form: This service is of a one-time nature and terminates upon placing an Order or earlier discontinuation of the ordering process by the Customer.
  • Newsletter: This service is provided for an indefinite period. The Customer may unsubscribe at any time by clicking the link in the email or sending a request to [email protected].

2.3. Technical Requirements: To use the Store, a computer or mobile device with Internet access, a web browser (with cookies and JavaScript enabled), and an active email account are required.


3. Terms and Conditions of Sales Agreements

3.1. Product prices are listed in Polish Zloty (PLN) and include all taxes (gross prices). Delivery costs are calculated separately and indicated during the checkout process.

3.2. Order Procedure:

  1. The Customer selects the Product and fills out the Order Form.
  2. The Customer confirms the order by clicking the “Buy” (or equivalent) button.
  3. The Seller sends an order confirmation to the Customer’s email address.
  4. The Sales Agreement is considered concluded upon receipt of the confirmation by the Customer.

3.3. Order data is recorded and secured in the Store’s IT system to ensure transaction security and verification.


4. Payment Methods

4.1. The Seller provides the following payment methods:

  • Bank transfer to the Seller’s bank account.
  • Electronic payments and card payments via operators (e.g., PayU, Stripe, BLIK).

4.2. Payment Deadline: The Customer is obliged to make the payment within 7 calendar days of concluding the Sales Agreement. Otherwise, the order may be cancelled.


5. Costs, Methods, and Delivery Terms

5.1. Delivery is carried out within the territory of Warsaw.

5.2. Available delivery/collection methods:

  • Courier delivery to the specified address.
  • Personal pickup at: ul. Radna 13, 00-341, Warsaw.

5.3. Delivery Schedule:

  • The delivery date is selected by the Customer in the calendar during checkout.
  • Delivery is carried out within selected time intervals (e.g., 10:00 AM โ€“ 1:00 PM).
  • Attention: On high-demand days (Valentine’s Day, March 8, Mother’s Day), exact delivery times are not guaranteed, of which the Customer is informed in advance.

6. Complaints and the Right to Withdraw

6.1. Warranty for Perishable Goods (Flowers): The Seller guarantees the freshness of flowers for 2 days from the delivery date, provided they are properly cared for. In case of quality issues, the Customer must report the defect within this period, attaching photographic documentation.

6.2. General Complaint Provisions:

  • The Seller is responsible for Product defects under the provisions of the Civil Code (Art. 556โ€“576).
  • Complaints should be sent to: [email protected].
  • The processing time for a complaint is 14 calendar days.

6.3. Right of Withdrawal (for Consumers): A Consumer has the right to withdraw from the agreement within 14 days without giving any reason. Exception: The right to return does NOT apply to perishable goods (flowers), custom-made products, and other exceptions provided by law.


7. Final Provisions

7.1. Agreements are concluded in the Polish language (this English version is for informational purposes).

7.2. The Seller reserves the right to make changes to these Rules for significant reasons (changes in law, payment/delivery methods). Changes take effect upon publication and do not apply to orders placed before the effective date.

7.3. In matters not regulated by these Rules, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

7.4. Any disputes shall be resolved through negotiation. If no agreement is reached, disputes shall be settled by a competent court.
